A public sector outsourcing boom is predicted but the legal risks could seriously impact the profit margin for private companies who need to recognise all the employment and pension pitfalls and ensure the deal is costed correctly.
It is said that "every cloud has a silver lining" and as the Government struggles to reduce the UK's massive public sector debt it is predicted that private sector companies will be the beneficiaries of an outsourcing boom.
It has recently been reported in The Guardian that:
"Outsourcing firms are preparing for a bonanza of local authority contracts to provide everything from bin men to back office bureaucrats and have reported a doubling in the number of deals on offer this year.…"
But is all that glistens, gold? There may currently be buoyant demand for outsourcing services from the public sector but are these opportunities really so lucrative for the private sector?
There are significant legal risks involved in outsourcing, not least as a result of the operation of TUPE. Without a proper understanding of the potential pitfalls private companies may discover, too late, that their costs have soared and their profits have plummeted.
