Tom is a property litigation solicitor with over 10 years experience.  Tom advises clients across a range of sectors on a wide range of commercial property issues and disputes.  Tom will always try and resolve a dispute without recourse to litigation where possible but if proceedings cannot be avoided then Tom has extensive experience of litigating in the County Court, the High Court and the Property Tribunals. 
 
Tom's recent experience includes:
 
  • Registering a Light Obstruction Notice against a well known tower in Manchester City Centre in connection with a substantial proposed re-development.  The process involved the service of over 500 notices on those with an interest in the tower.  The successful registration of the Light Obstruction Notice will potentially avoid the payment of millions of pounds in compensation. 
  • Acting on behalf of a landowner to defend a claim brought by their tenant seeking specific performance of an option to purchase the property.  The commercial property was worth in the region of £950,000 and the claim was defended on the grounds of delay and alleged termination of the contract created by the exercise of the option.  The claim was settled on favourable terms negotiated at a mediation. 
  • Acting on behalf of a commercial property developer in a dispute with a local authority.  The developer had expended money obtaining planning permission for the site following a successful tender process in anticipation that the local authority would contract to sell the site. The local authority sought to re-market the site.  Tom deployed various arguments in favour of the developer such that the local authority was persuaded to proceed on the terms originally agreed.
