Experienced commercial property litigator with a focus on development work
I am a Principal Associate in Shoosmiths’ property litigation team, with over 11 years of experience. I advise clients operating in all of Shoosmiths’ key sectors across the full spectrum of commercial property disputes. I have a particular specialism in development issues. I help clients overcome development constraints such as rights of light and restrictive covenants and to obtain vacant possession of development sites. I also advise clients on issues arising out of planning promotion agreements, overage agreements and contracts for the sale and purchase of land. I will always try and resolve a dispute without recourse to litigation where possible. If litigation is unavoidable then I have extensive experience of litigating in the County Court, the High Court and the Property Tribunals.
My recent experience includes:
-
Acting on behalf of a developer of a BTR apartment block to obtain an urgent interim injunction in the High Court to prevent the neighbouring owner from disposing of their land without first complying with their obligations to grant rights for the siting of two substations necessary to power the block;
-
Acting on behalf of a developer to register Light Obstruction Notices on an urgent basis against five residential apartment blocks to protect a new development comprising 2,500 new homes and 54,000m2 of commercial space;
-
Advising a developer in a dispute with a local authority regarding the extent of the authority’s obligations to accept a transfer of the public open space following the completion of the development.
