New UK Vertical Agreements Block Exemption comes into force

The new UK Vertical Agreements Block Exemption Order (commonly abbreviated to "VABEO") has come into force today, 1 June 2022. The block exemption governs how UK competition law applies to "vertical" agreements (including exclusive and selective distribution, franchising and agency).

The new rules are largely a case of updating the rules that applied under the EU Vertical Agreements Block Exemption (which applied in the UK until 31 May 2022). However, together with the accompanying CMA guidance (which remains in draft and will hopefully be finalised shortly) there are changes that will be of interest to businesses - in particular, in relation to online selling.
