Mahesh is a legal director in our Financial Services Disputes and Investigations Team.
He has acted for a broad range of finance clients, which includes the major UK clearing banks, private banks and funders and large corporate organisations. Mahesh’s experience in banking and finance disputes covers both regulated and unregulated lending products across a wide spectrum, including asset finance, contractual/commercial disputes, recoveries, litigation involving fraud, mis-selling claims, and consumer credit disputes.
Mahesh’s work highlights include:
- Acting for and advising a retail bank who was victim of a multimillion-pound asset finance fraud.
- Representing a major retail bank in respect of a £2.4m defended buy-to-let secured portfolio shortfall claim against a group of defendants. The claim considered well-established principles of agency in respect of receivers.
- Acting for a Bank in respect of contested possession action for commercial property, which is subject to an application for permission to appeal. The case will consider the principles established in Vodafone v IPCom.
- Acting for a Bank to defend a claim for breach of confidence brought by a consultancy firm that alleged the Bank stole and then utilised confidential information.
- Representing for a well-known brand in respect of all regulatory and civil claims arising from a data breach affecting a large number of data subjects.
- Advising a major motor vehicle stock funder in respect of large-scale misuse of facility. This included investigating underwriting documents, using data analytics to determine patterns of fraud, recovery of assets unlawfully disposed to third parties, and litigation against the offending company and guarantor and co-conspirators.
- Acting for and advising major motor finance clients (funders and suppliers) in their response to the motor finance commission mis-selling wave.
